The nature of electronic data and records makes the issue of preserving evidence during the early stages of litigation particularly important. While a company may not be required to issue and implement a legal-hold notice, the Federal Rules of Civil Procedure call for parties to exercise due diligence and make reasonable, good-faith efforts to identify and preserve relevant electronically stored information (ESI). The importance of ESI in litigation is apparent in the 2006 amendments to the Federal Rules of Civil Procedure. << 收起
